Description Evidence as a procedural activity has a close connection to criminalistics. Code of Criminal Procedure does not stipulate usage of all criminalistics methods nor determines the procedure during exercise of tactical procedures and technical instruments that are used in criminalistics. Act of authorities active in criminal proceedings that causes a lot of disputes in practice for certain period of time is the usage of scent identification method/ scent identification as evidence in criminal proceedings. The decision making practice of Constitutional Court will be concerned as a basis to answer questions concerned to try figure out if the scent identification as evidence in criminal proceedings is admissible or not and what is its’ relevance (which is the most questioned aspect according to literature).
