Description The paper deals with the consumer position in relations with entrepreneurs, specifically with the consumer health legal protection in connection with misleading commercial practices of entrepreneurs in the Czech Republic. The paper is focused on the (i) union; and (ii) Czech (public and private) principals, standards and means of the consumer health legal protection in connection with misleading commercial practices. The main purpose of the paper is to determine, whether the legal regulation in the relevant union and national (Czech) acts represents the adequate standard of the consumer health protection against misleading commercial practices of entrepreneurs during their business in the territory of the Czech Republic and which activities of entrepreneurs are in relation to consumers (and their health) prohibited in the Czech Republic. Selected examples from the practice demonstrate how the Czech administrative and judicial authorities proceed if relevant rules are breached, and how specifically is decided about these violations in the Czech Republic. The end of the paper summarizes and completely evaluates the findings from the examined area and the authors also do not omit to mention their de lege ferenda drafts.
