Description The contribution will focus on the out-of-court settlement of disputes arising from contracts concluded in doorstep selling of energies where consumers are offered a tender of the cheapest energy supplier free of charge. The problem arises when a consumer refuses to conclude the contract with the supplier or cancels it. In this case, the consumer is penalized by the supplier or intermediary for obstructing the energy supplies. As partsof the contractual relationship, there are an energy intermediary, supplier and consumer. The subject of the out-of-court settlement of disputes in the field of energy industry is the Energy Regulatory Office, but it is not competent in the case of disputes with a mediator of energy auctions. The paper aims to answer the question what subject is competent to solve the disputes and what are the mechanism of the out-of-court settlement of consumer disputes. It also aims to determine problematic aspects of the given model.
