| Description | The article deals with operation of air and rail transport on the basis of exclusive authorization in the context of COVID-19 pandemic. Its aim is to analyse the conditions under which EU Member States may grant carriers exclusive authorization to operate air, resp. rail transport, and to find identical features and differences in the legal regulation of both modes of transport. Although the two legal regulations have many identical features, such as the exceptionality of the exclusive authorization procedure or the general requirement of a previous tender procedure, the differences tend to prevail. Due to certain shortcomings of the legal regulations in question, which may emerge in extraordinary situations, the article also suggests their possible changes de lege ferenda. |
