| Description | Last year, in two decisions, the courts of first instance addressed the question of whether a derivative action can be used to seek compensation for damage caused to the cooperative by an invalidly elected member of the board of directors. This text will present the conclusions of both decisions, critically evaluate them and present its own solution to the question. |
