| Description | The authors will firstly define mediation, which origin and development is connected with the late modern societies of the late 20th and early 21st century, and then the current tendencies preferring ADRs, to which mediation undoubtedly belongs. Mediation is based on the acceptance of one's own responsibility for resolving disputes and on the autonomy of the individual to freely choose such method. The authors will focus on the considerable differences between the theory and practice in mediation, in particular on the lack of clarity of the concept of autonomy in relation to the voluntariness of mediation, on the lack of awareness of this option and on the lack of trust in this solution. They will provide selected empirical data to support their claims. |
