| Description | This third part of our series focuses on various legal aspects of direct effect of GATT/WTO law in EC member states. If GATT/WTO law has a direct effect it would mean that an individual on the territory of EC Member States would be able to challenge the EC law as being inconsistent with GATT/WTO law. Though the concept of direct effect is viewed amiably by some of Advocates General of ESD, the Court himsepf holds the negative position regarding this phenomenon permanently. THis Article tries to display both ECJ reasons and argumentation of several ECJ position critics. |
