Description The paper is based on the analysis of several diplomatic documents from the 12th and 13th century trying to clarify the nature of aristocratic testaments. Consistent with previous research comes to the clear conclusion that the domestic testamentary practice differed from conception of Roman law. And in the sense that until the early modern period was testament based on singular succession. Through the experts in canon law was the domestic testamentary practice influenced by clauses derived from Roman law, which are becoming an integral part of domestic forms.
