| Description | : The aim of the present paper is to theoretically describe the concept of international element used in international private and procedural law, to clarify the concept of internationalization of domestic relations and outline the situation when it is possible by certain declaration of will or activity incorporate an international element to an otherwise purely domestic relationship. The article is based on the fact that there are the legal relations in which the international element occurs objectively, i. e. independently of the will of the parties, and there can be found some situations where the parties of legal relations incorporates an international element intentionally by their declaration of will. It can be done by choosing a foreign law, choice of foreign court or foreign arbitration body, choosing the place of arbitration abroad, choosing a foreign arbitrator, assignment of the claim or transfer a debt abroad, moving the seat or residence (domicile) abroad, etc. |
