| Description | The article deals with the system of human rights protection in Europe. However, it does not primarily focus on the European Convention on Human Rights, but on the development of the fundamental rights protection within the framework of the European Union. The paper initially pays attention to the first phase of the European integration, during which norms for human rights protection were missing in the primary law. Therefore it was necessary to overcome the shortage by means of interpretation. The work further deals with the gradual elimination of the deficit and it discusses the Charter of Fundamental Rights of the European Union, its entry into force and also the possible future development of the human rights protection in the European Union. |
