Description The paper is focused on analysis of recent judgment of the European Court of Justice of the EU (the ECJ), in which the Court examined the issue of intellectual property. The fundamental problem was represented by question of how far the entity, which represents authors, composers and publishers of musical works can go when protecting rights of such subjects. The ECJ was solving the problem whether instrument of injunction requiring the installation of the (specific) filtering system regarding the information/data on online social networking platform is admissible. Firstly the argumentation of the Court analyzes the aforementioned instrument in context of certain Union’s directives, secondly it examines the relationship between the right to intellectual property and other relevant rights and freedoms guaranteed by the Charter of Fundamental Rights of the EU. The paper is closed by introduction of the author’s own point of view regarding the final statement of the ECJ.
