| Description | This contribution is dealt with the theme of the Amendment of the The Criminal Procedure Code No. 459/2011 Coll. of Laws. The amendment is mostly described as „The Custodial Amendment“. The denotation is not entirely exact because the big part of the amendment resolves other questions (e. g. search in other premises and land, applicability of some other proves in criminal proceedings and theme international judicial cooperation in criminal cases, etc.). The article pays the attention to the problems of (investigatory) custody, especially main pieces of news in the legal regulation (e. g. changes of grounds for custody, distinct way of deciding about other duration of custody in framework of preliminary proceedings – court newly decides about it). The contribution also mentions specific questions relating to application of temporary provisons of this amendment of the „Custodial Amendment“ (e. g. inclusion of lapsed time to the time-limit for decision about other duration of custody after 1st January 2012). |
