Description This article deals with the relationship between § 1598 and § 1512 of the Czech Civil Code 2012. § 1598 (Falcidian Portion, quarta Falcidia) stipulates that the heir can retain one quarter of the estate even in case the estate is overburdened with legacies. § 1512 regulates Universal Trust (Svěřenské nástupnictví), that originates from fideicommissum hereditatis, on which would be the rule of Falcidian Portion applied according to Roman law. However, Universal Trust became during its historical development rather sort of heir appointment and loses its nature of bequest. This process is reflected by systematicness of the Czech Civil Code 2012. As a result, Falcidian Portion is not applied on Universal Trusts.
