Description Plea bargaining has well established position in Slovak legal regulation since recodification of criminal law in 2005. Supreme Court of Slovakia and Constitutional Court of Slovakia created a rich and stabile case law related to plea bargaining during past years. Since September 2012, there is also plea bargaining institute incorporated in the Czech criminal law. Czech legislator drew his inspiration from the Slovak legislation and application practice while establishing this institute. The aim of this article is to analyze relation between court practice concerning plea bargaining in Slovakia and Czech legal regulation of this institute, with significant consideration of compulsory defense while negotiating the plea bargain.
