| Description | Falcidian portion is a quarter of the decedents’ estate that can be retained by the heir even if he is asked to give it to someone else. Chapter 1 and 2 serve as an introduction. The main part of the thesis are chapters 3 and 4 that are in detail dealing with problems of application and calculation of the quarter as well as with its extension on other mortis causa dispositions. Chapter 5 examines its development in Byzantium, Germany, Switzerland, England and Catalonia. Chapter 6 examines its development on the territory of the Czech Republic, where it became topical with the new civil code. |
