Description Aforesaid post discusses one of the most significant right of the accused in criminal proceeding – the right to defense (right to attorney), which warrants and guarantees the right to fair trial. The author, with regard to its widespread, is not dealing with this right in his whole content, but only with chosen aspects of this phenomenon from perspective of application practice of police authority and decision making activity of Constitutional Court and common courts as well.
