| Description | The contribution focuses on particular traits of the inquisitorial criminal procedure which are mainly based on historical and cultural context of European countries. According to the author these traits are the most important factor which impacts on the current form of criminal procedure in particular European countries. The contribution describes both the historical creation of the public prosecution service in the 19th century and its further development. Particular institutes are analysed as well (principles of opportunity and legality, principles of material and formal truth, actio popularis, jury etc.). |
