| Description | In her contribution, the author deals with procedural rights of children under the age of fifteen within the proceeding of civil nature, which reacts on the otherwise criminal acts by the reason of lack of deliquents´ age. Regarding the fact that there is an intersection of civil and criminal elements in this proceeding, the author critically thinks about the range of procedural rights, that ´zákon č. 218/2003 Sb., o soudnictví ve věcech mládeže´(Code of Juvenile Justice) provides to these kids. Having evaluated the deficiencies of legal regulation on the part of guarantee of criminally irresponsible children´s rights to fair trial, the author proceeds to formulate some conclusions de lege ferenda within the subject in question. |
