Description The ne bis in idem principle, which expresses the prohibition of anyone’s double prosecution or punishment for the same act, is seen as one of the fundamental human rights guaranteed at the national as well as international level. Within the European criminal law, it ensures legal certainty and the protection of the individual not only within one Member State, but throughout the area of freedom, security and justice. The contribution in this context refers to the importance of the ne bis in idem principle in an environment of European criminal law, where the problematic issues are discussed in connection with the case law of the Court of Justice of the European Union.
