| Description | An issue of “culpability” of legal entity represents one of the most controversial, yet elementary questions related to criminal liability of legal entities. Recent (and not just local) legislation is a bright example of the fact that this specific field of law is highly reflected not only by theory of criminal law. Therefore an author gives deep consideration to current construction of accountability of certain physical individual’s culpability to legal entity (according to sec. 8 art. 2 of Czech Act on Criminal Liability of Legal Entities) and its theoretical background as well as practical application, rethinks if it does not deserve particular reassessment and formulates possible sollutions of analyzed state of affairs. |
