Description This study examines question of international liability for injurious consequences of acts not prohibited by international law, which had been put on the working programme of International Law Commission in 1978. Thirty years later the project was shifted to the list of completed topics. The report introduces in general terms the final version of Draft principles on the allocation of loss in the case of transboundary harm arising out of hazardous activities and indicates problems which should emanate in the relation to the sectoral regulation existing in the sphere of atomic energy. Author points out, that Draft principles are due to the lack of strict liability of states and stipulating the principles of the allocation of loss as primary norms in the relation to Temelín dilemma inapplicable, if not inadvisable.
