| Description | This article deals with the limits of the principle of the opportunity in the criminal procedure. After a critical analysis of a current legislation and brief summary of its concept within a recodification of Czech criminal procedure the author examines the reasons for the possibility of opportunistic process and examines its legitimacy. The main part of this article deals with special kind of procedural opportunity – expansive opportunity – which relates to obtain information to detect the serious crime from the accomplices in exchange for theirs certain benefits. The author defines its conceptual character, and confronts it with Czech legislation. At the end the author answers to the questions about the legitimacy of the institute of accomplice witness. |
