| Description | The paper deals with the issue of the scope of the Administrative Procedure Code, specifically whether it covers the activity of the Public Defendor of Rights, an institution intended as free from prescribed rules of performance. Contrary to the general opposite opinion the paper points out the question is, at least in the Czech Republic, disputable at least due to the delimitated scope of effect of the Administrative Procedure Code in a way that it covers all the performance of the public administration. At the same time, it can be speculated if the activity of the Public Defendor of Rights is really excluded from this category. |
