Description The process of law-making has an irreplaceable place in legal practice as well as in legal theory. This process is very closely associated with the specific identity of each legal system that creates the conditions for its clear operation. Identifying them means identifying legal identity and understanding the context in which lawmaking takes place. The meaning of the context, which represents a comprehensive system of traditions, customs, disciplines and identities, is given by its ability to reproduce the legal system. The contribution will focus on the cultural determination of law-making in the Czech Republic. The real process of creation, which is still outside the Parliament of the Czech Republic, in the administration. Capital (Bourdieu) and discipline (Foucault) of legislative and technical law makers are an essential part of this process. Therefore, the contribution will focus on the potential cultural determinants that these subjects may be exposed to.
