Description The article deals with changes in the legal regulation of spatial planning, which brings the recodification of building law and with their impacts on participatory democracy in this area important for the development of the territory. The article concludes that according to factual intention the new building act would restrict the participation of persons concerned by spatial planning and this would weaken participatory democracy in this area in favor of representative democracy.
