Description | Competition authorities (the CCA and the Commission with respect to the Czech Republic) have a number of investigative powers when investigating possible anti-competitive conduct. The most important one is an on the spot investigation, which may be conducted without prior judicial approval. The aim of the on the spot investigation is to secure evidence. Undertakings under investigation are obliged to cooperate with the authority, i.e. to provide the authority with access to business records and with necessary explanation. Noncompliance with this obligation may be fined by the authority. Is such a procedure in compliance with constitutional law, more precisely with the principle of non-coercion to self-accusation? |
