| Description | The principle "ne bis in idem" also extends to the area of administrative criminal law but the responsibility for several delicts committed by the same conduct may arise in some specific areas. The principle "ne bis in idem" does not apply to the concurrence of a public sanction and a private corporate sanction against a corporate representative. The duty of care must be assessed in principle according to an objectified standard, including consideration of society-wide (and not just corporate-related) values. |
