| Description | The constribution deals with following questions: (i) in the courts of which State the injured entrepreneur whose right to a trade name has been infringed may sue the infringer of his right, (ii) whether, in such a court, the injured entrepreneur may sue for damages in a whole (including parts incurred in other countries as well); and (iii) how criteria set down the Brusel I bis Regulation for determination of courts of EU state with international jurisdiction for these disputes differ from criteria set down in the CLIP Principles. A significance of qualification of the infringement under lex fori will be mentioned at the beginning of the contribution. |
