| Description | The social function of private tort law is primarily to ensure equivalence.Nevertheless, some functionally comparable ways to achieve overcompensatory damages can be identified, such as excessive liquidated damages, compensation for continuously increasing lost profit, loss of business opportunity, commercial impairment or so-called pure economic loss.The hypothesis is advanced that the functionality of the legal instrumentarium of damages does not suffer from the absence of multiple or punitive damages. |
