Description The article deals with the principle of party autonomy (autonomy of will) in civil procedure. It also focuses on the question of whether and in what situations this principle can be limited, and how far these limitations can extend. These issues are examined in the context of particular civil procedural institutes in which party autonomy is strongly reflected (e.g. commencement of proceedings, binding the court by the action, amendment of the action, waiver of the claim, etc.).
