Description The article deals with whether it is a prerequisite for the validity of a contract of sale that the seller is also the owner of the transferred property at the time of its conclusion. This problem exists in particular in a situation where it is obvious at the time of conclusion of the contract that the seller does not have the possibility to become the owner. The article criticizes the solution chosen by the Supreme Court, which concluded that the validity of the contract requires the transferor to be the owner at the time when the application for registration of the ownership right to the property is filed. If this requirement is not met, the Supreme Court held that the contract should be void.
