Description The concepts of objectivity and balance in broadcasting are among the central normative concepts of broadcasting regulation (see Article 31(2) and (3) of Act No 231/2001 Coll., on the operation of radio and television broadcasting). Despite the frequent use of these audiovisual broadcasting correctives, there is insufficient agreement on their content or definition. Due to its critical focus, the article has chosen media theory as a starting point, which understands the concepts of objectivity and balance in a different context than their use in the legal environment. This is due to their insufficient grasp and the “mechanical” approach to understanding balance or objectivity both in media practice and in subsequent legal evaluation. Therefore, the article grounds its analysis of the media-theoretical method and, consequently, of the existing findings in legal theory and practice, which provides an informed basis for further reflection. Based on these findings, the article presents value-cognitive instrumentation offering appropriate procedures for assessing whether a message (media content) falls within the scope of the relatively abstract notions of objectivity and news balance. The article is conceived doctrinally as a search for coherence between the media-theoretical approach and legal solutions to the problems associated with objectivity and news balance in broadcasting.
