Description Justice is constantly evolving in relation to the perpetrators of the acts otherwise crimi-nal, from repressive to restorative justice, from hostile to friendly one, or at least at-tempts to do so. Therefore, there is a certain change in values, when due to the overlap of this issue also in the field of civil law, their range is relatively wide. However, despite noticeable developments in the last decade, Czech legislation still struggles to grasp this issue, which is further reflected in the treatment of children in court proceedings. My contribution therefore takes a critical approach to its current state. Specifically, it will deal with the procedural treatment of a child under the age of 15, in quasi-criminal pro-ceedings where the child is treated as a perpetrator, or preferably a person who needs help. The contribution will look at it through the perspective of both theory and practice, both from the point of view of domestic legislation and it will reflect the proposition of an amendment of the Act towards the child-friendly justice
