Description Chapter addresses the rights of publishers of press publications for their online use, which were introduced by the amendment to the Copyright Act No. 429/2022, in connection with the transposition of Article 15 of EU Directive 2019/790. These rights are purely economic in nature without a personal component, are transferable, and have a duration of 2 years from the publication's release. The protection applies to publishers of press publications from the EU and EEA and is limited to information society service providers. The rights are independent of copyright and cannot be used against authors of works contained in the publications. The subject of protection are press publications defined as collections of literary works of journalistic nature, including photographs and videos, but excludes academic publications and content not published under the publisher's control. The protection does not extend to the use of hyperlinks and very short extracts. The rights allow publishers to decide on the online use of their publications but are limited in the case of non-commercial use by individual users, licenses, and content whose protection period has expired. The Directive and the Czech Copyright Act further stipulate that publishers of press publications must receive a fair share of the revenues from the online use of their publications.
