| Description | The book deals with the legal regulation of the right to a trade name as a subject designation of an entrepreneur, under which the entrepreneur carries out his business activities, and seeks to answer the question whether the Czech Republic protects the right to a trade name correctly, or how to amend the present legal regulation. A trade name is a potentially valuable asset in the possession of an entrepreneur, which should be properly protected in the legal system of a given country. The monograph thus provides a basic conceptualisation of the trade name as an intangible asset and the law relating to it, a mapping of the possibilities of resolving disputes arising from non-contractual infringement of the trade name right and guidance on determining the applicable law and the appropriate forum for such disputes. All of that while reflecting the national laws of the Czech Republic, Slovakia, Austria and Germany, the conclusions of the World Trade Organization and the Court of Justice of the European Union in the context of the Agreement on Trade-Related Aspects of Intellectual Property Rights and the Paris Convention for the Protection of Industrial Property. |
