Old Environmental Contamination in the EC Legal System - New Development

Description The aim of this contribution is to outline legal requirements in connection to contaminated sites in member states and its implication for national legal systems. To fulfill the aim, selected parts of the EC legislation will be analyzed. The analysis will be focused on the new Waste Framework Directive 98/2008/EC, Directive 2006/21/EC on waste from mining industries, Water Framework Directive 2000/60/EC, Directive 2006/118/EC of the European Parliament and of the Council on the protection of groundwater against pollution and deterioration and on the proposal for a Directive of the European Parliament and of the Council establishing a framework for the protection of soil and amending Directive 2004/35/EC. The well known case C-1/03 Paul Van de Walle and Others v. Texaco Belgium SA decided by the the Court of Justice of the European Communities will be analyzed with respect to the changes brought by the new Waste framework Directive.
