Description | The Article 12 par 2 of the Constitution of the Czech Republic states that nobody shall be deprived of his nationality against his will. This maxim is however impugnable in the cases when the nationality has been acquired through naturalization and afterwards is discovered that the applicant has stated in his application false facts or he has even used other tricks such as the bribery or coercion. Is the nationality which has been obtained on such a way really inviolable? This text argues with the references to the recent German judicature for the acceptableness of the cancellation of the naturalization in such cases without interfere the Czech Constitution. The very actual citizenship of the European Union is also not left aside. |
