Description At times, artists seem to challenge legal rules while at the same time calling their activities “art”. When facing an accusation, they defend themselves saying: “We did not breach law because all we did was fine art.” This paper addresses the questions the judge finds herself facing when the gravity of problems reflected by the works of art may be contrasted with the gravity of the infringement of law, drawing on recent examples of works of conceptual art in the Czech Republic.
