| Description | The article is devoted to the new legal regulation of advance payments on the costs of substantiation, specified under § 141 sec. 1 of Civil Procedure Code, as amended by Act. no. 7/2009 Coll. Due to the fact that the new version is not very satisfactory and gives cause to numerous doubts, the author of this article tries to explain it so as to respect one of the basic expressions of the right for just proceedings, i.e. the principle that economic obstacles may not prevent anyone from applying or defending his rights at court. Court protection is not only for the rich, but equally so for the very poor. |
