| Description | The article deals with the problematic of breaking rules in the new criminal Code, this regulation is in article 248 of this code. This legislation combines two valid articles which are more precisely concretized. The legislator in new code specified concepts and deleted the possibility of parallel criminal procedure and other uncertain things which brought the praxes. The author criticizes the necessity of fulfill all conditions, not only of the general clause, as well as concrete provisions of the criminal code. |
