| Description | A three-year battle over changes of Act No. 114/1992 Coll., on nature conservation and landscape had resulted into a significant amendment in form of Act No. 349/2009 Coll. This act presents a pre-advised response to infringement proceedings by the European Commission and several publicized measures, namely improved avenue protection, changes in the state administration, or exemptions from the law. Besides, § 90 paragraph 4 of Act No. 114/1992 Coll., a key provision for the determination of a relationship to the regulations which more or less affect the relations in nature and landscape, was repealed. Was it already an outdated provision? What are the consequences of its abolition? Which rules will now prevail in the case of conflict or duplication of regulations?
