Description § 31 of Act No. 216/1994 Coll., on arbitration proceedings, contain an exhaustive list of grounds, on which it is possible to annul an arbitral award. The control function of courts during arbitral proceedings is limited only to these grounds which are based on the autonomy of will of the parties. According to § 31 point g) upon the motion of either party court annuls an arbitral award if it finds that there are reasons that may be in civil proceedings to request renewal of proceedings. This reason is very problematic and is not clearly accepted in the literature. The aim of this paper is to confirm or refuse following hypothesis: The annulment of arbitral award because of reason, if there are grounds to request renewal of proceedings, is from the point of view of functions of arbitral proceedings and its legal regulation is not suitable and excessive.
