Description The current paradigm of the copyright law is its crisis and inability to deal with the challenges of rapid development of information and communication technology. This tension between the de lege lata regulation and the factual state is extremely manifested in the field of the copyright exceptions, mainly the private copying exception. The topic of this contribution is the analysis of the scope and limits of this legal institute. The contribution shall mainly focus on the European Union law (The “InfoSoc” Directive 2001/29/EC) and the national regulation. Also, the relevant decisions of the Court of the EU, as well as the national courts, related to the topic of private copying exception shall be discussed.
