| Description | The topic of this contribution is online arbitration and its selected issues. The text analyzes the business-to-consumer online arbitration from the point of view of recognition and enforcement of arbitral award. The consumer arbitration has itself its problematic areas. Nevertheless they emerge especially in the online context on the Internet. The recognition and enforcement of arbitral award as a result of online arbitration has its obstacles. The recognition and enforcement of online arbitral award in online cross border arbitration shall be governed by the New York Convention. The formal requirements for the arbitration clause according to Article II will be examined. As well as the public policy exemption under Article V Section 2 of the New York Convention. |
