| Description | This article deals with the elementary principles of the executory proceedings, especially with the protection of the third parties. This principle is connected with the possibility of taking of motion to exclude the thing from the list. The right to exclude the thing must be proofed. The aim of this article is to answer the question, whether the right of possession may be also protected by the motion to exclude the thing from the list. |
