The project focuses on the Model European Rules of Civil Procedure (MERCP) and - using the example of the Czech Republic as a representative of the Germanic (Central European) family of civil procedure - explores the possibility of their use in the reform of civil procedure. The research is focused on the key principles and institutes of the MERCP, such as the role of the court, parties and their representatives in proceedings (including the principle of cooperation and proportionality or so-called case management), the subject matter of the dispute (and its manifestations in the impediment of lis pendens or res iudicata), tools for speeding up proceedings (e.g. concentration of proceedings) and judicial remedies. Methodologically, the project is based on the comparative method and the qualitative research method. The topics investigated and the methods used will allow a reliable assessment of the specific areas in which MERCP can inspire civil procedure reform in the Central European area.
