Description Basic principle of the justice is not only that the justice is done but also that the justice seemed to be done. This is the basis for the criticism of institute of the unilateral party appointed arbitrator in public international arbitration (not limited to the investment arbitration) and international commercial arbitration. However, this institute is still widely used and there are no signs that this practice will change in near future. The aim of this contribution is to compare the party appointed arbitrator in different types of arbitration – the public international law arbitration and the international commercial arbitration, and compare the objections to this institute in these types of arbitration. The comparison should allow to look for common grounds and possible solutions.
