| Description | This text gives comments on article 101 of the Act. No. 91/2012 Coll., on Private International Law. First of all it defines the legal institute of non-contractual obligation and its constructive elements in connection with the New Civil Code. Following part is devoted to the relation between the Czech legislation and international treaties and EU law. In this context the basic comment on conflict-law rules in Rome II Regulation is given together with crucial ECJ case-law. Afterwards the article 101 is analysed in detail. For more complex view the information about international jurisdiction in non-contractual obligation cases is added. |
