| Description | The article deals with different kinds and causes of inequality od contracting parties; the author is sceptical to any „binding“ definitions thereof. Usual approach to bargaining power based on a formal assessment of personal status of contracting parties is subject to criticism. The minimal benchmark of fairness may be set by both private law and public law means and it not rarely happens so; nevertheless, private law approach should prevail. |
