Description The article deals with significant market power and bargaining power and doesn´t consider them to be synonyms. The alleged reasons for special legal regulation of subdominant market power on the demand side are assessed with criticism. Significant market power is in fact a kind of „qualified subdominance.“ The objective concept of significant market power promoted by the Czech antitust authority doesn´t take into account the context and pushes down the threshold for defining market power. This regulation may even protect a dominant suplier against its buyer possessing mere significant market power .
